The Company as Taj India Trip accepts bookings subject to the terms and conditions mentioned herein, which agreement shall constitute the entire agreement between the parties.
This booking and the contract thereafter shall be deemed to have been made at Agra, India and shall be interpreted in accordance with the laws of the Republic of India. The parties consent to the jurisdiction of the Magistrate Court of Agra. The Company shall have the discretion to sue in the Civil Court Agra at its discretion if it deems fit.
All prices and services are correct at the time of printing. All prices, services and departures are subject to change without prior notice. The Company reserves the right to change the published price of any tour due to rising tariffs, costs and entrance fees or fluctuations in exchange rates, such amounts shall be determined at the Company’s discretion.
The Taj India Trip Company reserves the right to refuse any booking without giving any reason. No booking shall be considered confirmed until a written confirmation slip has been sent to the Agent/Client and the full amount due has been paid and all cheques have been paid.
If the full amount is not paid thirty (30) days before departure, Taj India Trip Company reserves the right to treat the booking as cancelled and the deposit will be forfeited. Passengers booking within thirty (30) days of tour departure are required to pay the full amount immediately to secure their seat.
In case of cancellation of tour/tour services due to any avoidable/unavoidable reason, we must be informed in writing. Cancellation charges will be effective from the date we receive the notice in writing, and the cancellation charges will be as follows: 30 days to 60 days or more before arrival: 10% of the tour/service cost 16 days to 29 days before arrival: 50% of the tour/service cost Up to 15 days before arrival or No Show: No refund Note: Written cancellations will be accepted on all working days except Sundays, any cancellations sent on Sunday will be considered on the next working day (Monday).
Payments are non-refundable during the Christmas and New Year period from 20th December to 5th January each year.
Any traveller who joins a tour after the departure date, or does not join at all, or leaves the tour before completion for any reason whatsoever is not entitled to any refund from the Company, or to claim any costs for any additional expenses incurred. However, in this case the Company agrees to refund all monies already paid by the Client. This shall be the Company’s sole responsibility to the Client and no claim for any damages whatsoever, howsoever caused, shall be made against the Company.
* It is the sole responsibility of the Client to ensure that the passport, visa, health certificate, proof of vaccination and any other required documents are all correct for the country to be visited. 3-4 blank pages must be available in the passport.
*If the Client does not take care of the Client’s documentation and related matters properly before the tour commences, the Company will not be liable for any consequences, damages or claims.
Comprehensive travel and cancellation insurance is compulsory on all tours. It is the Client’s responsibility to ensure they have this insurance and the necessary paperwork to prove this before embarking on the tour. Travel insurance must include comprehensive medical insurance including provision for air evacuation. The Client is solely responsible for any consequences resulting from not having this paperwork.
All baggage and personal effects are always the Client’s responsibility and the Company accepts no liability for any loss or damage to any personal effects howsoever arising. The Company reserves the right to refuse excess baggage.
The Client accepts that all tours involve an element of personal risk. Neither the Company nor any of its agents shall be held liable for any injury, loss of life or damage to property in any way howsoever caused and the Client indemnifies and holds harmless the Company, its agents, assigns and employees from any such claims. The Client accepts full responsibility for all risks involved.
The Client acknowledges that physical fitness and health is required to participate in the tour and it is the Client’s responsibility to ensure that they are medically fit to go on the tour. However, we do require a medical certificate or doctor’s letter for all Client’s over the age of 65 confirming that they are medically fit to go on the tour.
The decisions of the Company’s guide/driver on the tour shall always be final and binding. The Client must always abide by the laws, customs and foreign exchange regulations of the country he is visiting. If the Client is in contradiction to any of the above or the Client is a nuisance to the group, the driver/guide may order the Client to leave the tour without any claim for a refund.
You consent to us using your photographs taken during the tour for advertising and promotional purposes in any medium we choose. You give us a perpetual, royalty-free, worldwide, irrevocable licence to use such photographs for promotional and publicity purposes.
Optional activities not included in the tour price are not part of the tour or this contract. You acknowledge that any assistance given by your group leader or local representative in arranging optional activities does not make us liable for them in any way. The contract for the provision of that activity shall be between you and the Activity Provider.
Unforeseen circumstances, including but not limited to war, mechanical breakdown, weather, riots and other unforeseen causes beyond the control of Taj India Trip Company, may cause the tour to be delayed or altered. Taj India Trip Company shall not be liable in any way for any of these unforeseen events or for any consequences arising as a result of them.
At the time of booking, the customer is issued with our tour dossier and pre-departure information documents. It is the customer’s responsibility to read and understand these documents prior to travel.
